Threads ARE NOT USUALLY open in this forum. To file a protest use ALWAYS the Protest Editor, if the protest references a saved race use the link provided in the Results/Replays option for that race. If the protest cannot be referenced by a racelet use the Editor from the Protest Room option, Thank you.

Llegando a la boya de sotavento, llegamos muy justos. Yo creo qu ellegamos comprometidos ya que el va mucho mas orzado que yo. Si entramos comprometidos no me deja espacio.
De todos modos por si las dudas en el momento me penalizo.
gracias

System Info:ESP322 was given a pen at t=183 (RE:Rule 18 - Mark room (!!)).    ESP322 raised the P flag at=187.  ESP322 span at t=206.

ESP,

It looks pretty certain that there was no overlap when CALM entered. The rules system is quite good here, and if it sees an overlap, it will draw a line between you and the other boat (green if you have inside).

** Larger version **

So, ESP breaks 18.2(b).

However, this does not mitigate CALM's breach of R15 at t=197. CALM, you have been in enough R15 protests to know what your obligations are. Not t'ing is simply taking advantage of a RE error and less knowledgeable opponent, not very nice.

** Larger (point at which CALM completes, Miami already avoiding)

ESP322 breaks Rule 18.2(b), spins to exonerate. Dismissed.
CALM breaks Rule 15 on MiamiSailing. DSQ, -300WTS.

Calm, as Neil says, you are here long enough and have been in enough protests to know what a Rule 15 foul is. Yet you continue to break it... An RAF will not be accepted for that foul.

If the protest committee finds evidence within the extents of the facts presented (racelet?) then they may choose to protest the boat for the incident in question... I think?

Hi guys,

Have a look at Rule 60.3 to see if the Protest Committee can protest CALM, who is a party to this valid protest.

Aloha!

I think the two incidents are completely separated and probably we cannot DSQ CALM in the 2nd one.

But there is no honor or fair-sailing in that R15 breach. A good sailor should ask immediately for RAF if a clear breach is shown in the racelet (but we cannot force users to be 'good' sailors).

I agree with Amando. You could go through any race replay on a witch hunt, and disqualify infringers. It is not fair to single out one person, just because the incident was brought to the PC's attention but was not flagged. I bet I could find 5 other people to disqualify from this race alone. And I watched a race recently where 2 admins collided and neither acted. So we are all capable of this.

Aestela and BigNeil are right. R60.3 does not allow the PC to protest a boat that is party to the protest and the information about that rule breach (the racelet) was from a report from an interested party (ESP322), unless there is a clear breach of R2/R69 and the PC acts under R69.1.a.

60.3
A protest committee may
(a) protest a boat, but not as a result of information arising

from a request for redress or an invalid protest, or
from a report from
an interested party
other than the representative of the boat
herself. However, it may protest a boat
(1) if it learns of an incident involving her that may have
resulted in injury or serious damage, or
(2) if during the hearing of a valid protest it learns that the
boat, although not a party to the hearing, was involved in
the incident and may have broken a rule;
(b) call a hearing to consider redress; or

(c) act under rule 69.1(a).

This is a simple breach of R15 that was not protested at the time of the incident. And is a separate incident from the protested incident concerning Mark room. The PC can do nothing.

BUT

CALM - consider this your one warning. Any further incidents like this, where you do not spin for a clear rule breach, and you will be in breach of Rule 2 - Fair sailing.

I concur with Frodo:
ESP322 breaks Rule 18.2(b), spins to exonerate. Protest Dismissed.

Aloha!
